An Analysis of Legal and Status Inequality in Women’s Employment from the Perspective of Ayatollah Javadi Amoli

Abstract
The issue of legal and status inequalities affecting women—one of the current social concerns in Iranian society—results from the lack of a precise articulation of the Islamic perspective on anthropology and ontology. An inadequate understanding of the stations of women and men, their assigned responsibilities, and their respective roles within the cosmic order has led to the assumption of inequality in the domain of employment. Accordingly, this article examines the views of a contemporary theologian who adopts a maximalist approach to religion, employing thematic analysis as its methodological framework. The thematic network derived from Javadi Amoli’s works indicates that, in his view, what distinguishes individuals are the perfections pertaining to the soul, which are shared between men and women and are referred to in this study as the overarching theme of “virtues.” By contrast, what is presumed to constitute inequality between men and women pertains to the contingencies of worldly life and aligns with divine wisdom aimed at ensuring the proper functioning of life in this world. These matters do not, therefore, generate legal or status disparities between the two sexes and are categorized under the overarching theme of “tasks.” Consequently, not only do both groups share the capacity for attaining genuine perfections, but they also possess common rights in many employment‑related matters.
