Principles of Criminal Policy in Imamiyyah Jurisprudence Based on the Social Teachings of the Holy Qur'an

Abstract
Criminal policy is an emerging, multidisciplinary science that seeks to study the causes and methods of crime-related policies, how society and government respond to these issues, and how social and political factors influence crimes. Therefore, initially, it falls within the scope of legal and political science; however, in terms of content, it is influenced by various social fields, especially culture. Considering the importance of this influence in Islamic society, the present study has examined some principles of Islamic criminal policy with a focus on the social teachings of the Qur'an. For this purpose, authentic religious documents, especially Qur'anic verses and interpretive sources, have been evaluated using the descriptive-analytical method, and since the Aristotelian logic of causality has been used to achieve the guidelines of the Qur'an, the ultimate and formal cause have been established as the basis for understanding the approach. On this basis, the aforementioned principles have been analyzed in two dimensions related to the goals and causes of punishment and the principles governing their implementation. The findings of this research show the maximum compliance of these principles with the teachings of the Qur'an and Islamic traditions; the necessity of implementing these principles to ensure social justice and fairness in the Islamic penal system and the priority of the approach of reforming and restoring society over retribution and punishing criminals, based on which the change in the criminal policy model from the existing authoritarian approach to restorative justice has been recognized as inevitable, so that a constructive interaction between the criminal, the victim and the society can be achieved and the quality of life and social relations can be improved.
